SHIPPING AND DELIVERY POLICY

Baatu Technologies Private Limited (herein referred to as “Company”, “We”, “Us”, “Our”) is engaged in the sale of child friendly digital devices or wearables (“Devices” or “Products”) to the customers (“Users”, “Customer”, “You” or “Yours”) which the Company may develop or has already developed for the purpose of being in possession of the children in order to monitor, filter and track their activities and location by way of the usage of the mobile application (“Application”), which is used to connect and synchronize with the Devices, and which is available for download on the Google Play Store for the Users. The Company operates on its website [www.baatu.tech] (“Website”) and through the Application coupled with the Devices (collectively referred to as, “Portal”). This Shipping and Delivery Policy (“Policy”) is a part of the Terms and Conditions along with all the rules and regulations stated therein which shall apply to the Users of the Portal. By registering or browsing or downloading or using or accessing any part of the Portal, You will be legally bound by this Policy. If You do not agree with any of the terms of the Policy, You can refrain from accessing or using the Portal. This Policy must be read in conjunction with other policies of the Company. Further, all capitalized terms used herein but not defined have the same meaning as ascribed to them in the T&C.

1. Shipping & Delivery

  1. When You use the Portal to purchase the Devices, You become eligible for the various delivery options made available to You. We intend to provide a hassle-free shipping and delivery experience. The delivery time would depend on the location at which You are situated and the time at which You purchase the Product.
  2. Once the order is placed by the User, the Product will be delivered from the warehouse/facility of the Company to the User’s address through delivery agents (“Delivery Partner”). Our team constantly monitors the status of the Products that are shipped to Your address. We try to ensure that the Products ordered by You on Our Portal reaches You on time or as soon as possible. However, this may be subject to unforeseen circumstances like delayed flights, bad weather, strikes, lockdowns, political strife etc. You may refer to the tracking column on Our Portal or the tracking link provided to You on your selected mode of communications by the Delivery Partner or Us, for updates on the Products purchased by You and the status of Your delivery. You will also receive updates from Us via SMS and email.
  3. The Company will assign the Products to the Delivery Partner for the purpose of delivery. The logistics and modalities of the delivery will take place from the
    warehouse of the Company directly to the address as specified by the User.
  4. All the Products purchased by You will be delivered to You at Your delivery address. However, if You are not available, You may discuss with the Delivery Partner to deliver the Product to You at a time that is convenient for You.
  5. If a Product ordered is deemed to be a missed delivery, due to non-availability of the User, the User may opt to return the order in accordance with the Refund, Return & Cancellation Policy, post which the Company would initiate a refund to the source of payment including the deductions, if any.
  6. If You ordered a Product on Our Portal and if it has not been confirmed for shipping/delivery or if there is any delay in the delivery, You may raise a complaint on Our Portal by contacting the Grievance Officer as per our Privacy Policy.
  7. If You have opted for cash on delivery, You are requested to furnish amounts which are appropriate to the value mentioned on the Portal or to a round off value so as to enable a speedy and convenient delivery process.

Return

If You are not satisfied with the Product that You have ordered on Our Portal, You may request for a return/cancellation of the Product. Further details of return/refund can found in Company’s Refund, Return and Cancellation Policy which may be accessed here

Disclaimer of Warranties and Liability

On the Portal, all the Services made available to You are provided on an “as is” and “as available” basis without any representation or warranties, express or implied except otherwise specified in writing by the Company.

    1. The Company may, at its sole and absolute discretion, vary or modify this Policy. The User shall not raise any claim against the Company or question its right to modify the Policy.

User Conduct

You shall not falsify Your personal information (including, but not limited to, name, email address, bank account details and/or any other information) or documentation as may be requested by the Company to dispatch any Product ordered on Our Portal.

You shall be responsible to pay for the Product ordered on cash on delivery mode.
It is Your responsibility to read carefully and familiarise Yourself with regard to the terms and conditions of this Policy and/ or the applicable policies of the Company.

Communications

When You use the Portal or send emails or other data, information, or communication to us, You agree and understand that You are communicating with us through electronic records and You consent to receive communications via electronic records from us periodically. We may communicate with You by SMS (including transactional, promotional, and/or commercial messages), email, or by such other mode of communication, electronic or otherwise.

Jurisdiction

  1. This Policy shall be governed in accordance to the laws of India. The Company reserves the right to make changes, amendment, addition, or deletion to the terms of the Policy at any time and without notice to You. For all matters related to or arising out of this Policy, the courts of Bangalore shall have exclusive jurisdiction.
  2. Any disputes arising from this Policy will be settled in accordance with the Governing Law and Dispute Resolution clause as stated in the Terms and Conditions of the Company.

Grievance Redressal Mechanism

  1. For the purpose of redressing the grievances with respect to this Policy or any other rules, or breach or otherwise, the User shall contact the Grievance Officer.
